This Article aims to draw the connection between how we conceptualize legal rights over information resources and our capacity to develop technologically neutral legal norms in the information age. More specifically, it identifies and critically examines three competing approaches to the idea of technological neutrality apparent in copyright jurisprudence. Ultimately, it is argued that true technological neutrality requires not simply the seamless expansion of legal rights into new technological contexts, but the careful, contextual recalibration of rights and interests in light (...) of shifting values and changing circumstances. As a normative principle, technological neutrality in copyright law thus demands a nuanced and relational understanding of the rights at play, and the social values that they seek to foster as technologies evolve. Ellul developed three powerful theses about technology: technological autonomy, technological determinism, and technological bluff. The Discourses makes clear that conventional Christianity saps from human beings the vigor required for active civil life. 3 And the Prince speaks with equal parts disdain and admiration about the contemporary condition of the Church and its Pope. 4 Many scholars have taken such evidence to indicate that Machiavelli was himself profoundly anti-Christian, preferring the pagan civil religions of ancient societies such as Rome, which he regarded to be more suitable for a city endowed with virtù. 5 At best Machiavelli has been described as a man of conventional, if unenthusiastic, piety, prepared to bow to the externalities of worship but not deeply devoted in either soul or mind to the tenets of Christian faith. 6In recent times, the only dissenting voice of note has been Sebastian de Grazia, whose Pulitzer Prize-winning intellectual biography, Machiavelli in Hell, attempts to rescue Machiavelli’s reputation from those who view him as deeply hostile to Christianity. 7 De Grazia argues that not only do central biblical themes run throughout Machiavelli’s writings but that these works reveal a coherent conception of a divinely-centered and ordered cosmos in which other forces (“the heavens,” “fortune,” and the like) are subsumed under a divine will and plan. Machiavelli in Hell points to evidence from throughout the Machiavellian corpus supporting an idea of divine ordination of earthly events, especially in the case of the accomplishments of extraordinary individuals. For de Grazia’s Machiavelli success in human affairs depends primarily upon the friendship of God.De Grazia’s interpretation of Machiavelli’s religious faith has, of course, proven controversial, not least because he introduces his case in a fairly unsystematic and speculative way. 8 But while de Grazia’s presentation may be somewhat haphazard, the general reading he defends has important merits that ought [End Page 618] not to be overlooked. It claims instead that both medieval Latin thought and many non-Western traditions embraced a position that coherently defends tolerance beliefs and practices. John Pocock's The First Decline and Fall (2003) presents a novel argument for drawing a clear distinction between medieval and early modern varieties of political thinking and writing that implicitly challenges the current historiographical trend that "softens" the dividing line between the two. The present paper critically examines Pocock's claim, which is based on the appearance of the theme of the historicity of the Roman Empire (imperial decline and fall) in early modern (and especially Florentine) political theory. The Western Middle Ages witnessed the emergence of a wide array of economic theories of public life and the common good that emphasized the worthiness (indeed priority) of ensuring a satisfactory arrangement of economic goods primarily for the sake of meeting the physical, temporal needs of individuals from all classes and orders. The chapter surveys a plethora of texts, dating from the middle of the twelfth century up to the end of the fifteenth, that considered pragmatic issues related to how (...) the material self-interest of human beings coincided with the augmentation of public wealth within a community, and especially how governmental policies promoted or hampered the goal of personal economic improvement. Despite the diversity of and occasional discordance among these writings, all of them fundamentally agree on two interrelated points: (1) the pursuit of material self-interest, rather than conflicting with or detracting from the common good, actually supports and enhances it; (2) the responsibility of government to promote the public welfare requires paying careful attention to the protection and promotion of private advantage. In Book 3 of his Politics, and again in Book 7, Aristotle makes explicit his disdain for the banausos (often translated ‘mechanic’) as an occupation qualified for full civic life. Where modern admirers of Aristotle, such as Alasdair MacIntyre, have taken him at face value concerning this topic and thus felt a need to distance themselves from him, I claim that the grounds that Aristotle offers for the exclusion of banausoi from citizenship are not consistent with other important teachings (found (...) in the eighth book of the Politics as well as in several of his other writings) about the nature of poesis (‘productive science’, which is the form of knowledge characteristic of the so-called ‘mechanical arts’). I further support this claim with reference to the role played by the mechanical arts within the Aristotelian framework of knowledge that one encounters in medieval European thought between the twelfth and the fourteenth centuries, with particular reference to Hugh of St. Victor, John of Salisbury, and Marsiglio of Padua. Authors from the twelfth to the sixteenth centuries defended recognizable principles of toleration. Some scholars have objected that ideas of tolerance originating during the European Middle Ages are irrelevant to modern theories of toleration. The present paper, building upon Michael Sandel’s concept of “judgmental toleration,” demonstrates the applicability of medieval tolerance in modern contexts. The essay initially surveys examples of the deployment of “judgmental toleration” during the Middle Ages in the writings of St. Thomas Aquinas, Nicole Oresme, St. Augustine, Christine (...) de Pizan, Francisco Suárez, and Bartolomé de Las Casas. Thereafter, the paper considers how “judgmental toleration” may prove useful in solving problems that arise in modern theories of tolerance, as reflected in the classical liberalism of John Stuart Mill and in deliberative democratic thought.
